There is close relationship between the offences of unlawful confinement and kidnapping.  Where unlawful confinement requires that the accused “confine” a person against their will (or to deprive a person of liberty), kidnapping requires the extra step moving, taking or transporting the person from one place to another. Accordingly, while kidnapping requires forcible confinement, forcible confinement does not necessarily mean that a person has been kidnapped.

Punishment for kidnapping is serious, especially if a firearm was used during the commission of the offence. If a firearm was used, the Criminal Code imposes a minimum of 5 years in jail.  The maximum penalty for kidnapping is life in jail.

If you have been charged with kidnapping or unlawful confinement, you need a trial lawyer with real experience.  If you have been charged in Cochrane, Medicine Hat, Calgary, Lethbridge or anywhere in Alberta, call 403.452.8018.  David Chow offers a free telephone consultation.
