In GBB's case, a notice of administrative penalty was issued in circumstances where GBB was arrested from inside of a home pursuant to a tele warrant. The police entered a private dwelling to effect the arrest and since GBB was arrested, right to counsel was owed. GBB asserted s. 10(b) rights to counsel several times. The police ignored GBB and made a breath demand. GBB did not refuse but simply requested a lawyer. Ultimately, the police not only violated several sections of the Charter, they also failed to give GBB a right to a roadside appeal. The Director of SafeRoads also failed to provide important documents. As a result, GBB's roadside sanctions were cancelled.
