R. v. W.G.B.
(Calgary, Q.B.). Client charged with attempted murder, unlawfully discharging a firearm, aggravated assault with a firearm and possession of a firearm in relation to allegedly shooting a person who was in his motor vehicle. After a lengthy trial, the Court of Queen's Bench Justice acquitted him of attempted murder, aggravated assaulted and all charges relating to the discharge of the firearm. The basis for the acquittal was due to frailties in eyewitness identification bolstered by evidence of the accused. WGB's case was a very difficult case because it involved a foot-chase where the accused definitely discarded the firearm. Ballistics confirmed that the discarded gun was the firearm used in the shooting. On first view of the disclosure, it was very easy to think the accused was guilty, when in fact, he was a completely innocent man. The accused claimed innocence in the "shooting" throughout. The case was won on a careful dissection of various low quality video images from cameras on buildings in the area. The defence also went to great lengths to prove who was the actual shooter.
