(Red Deer, P.C. - Assault Causing Bodily Harm). In any assault case a competent criminal defence lawyer will immediately evaluate the defences of justification: consensual fight and self defence. TCC was charged with assault causing bodily harm. Both defences of justification had an air of reality. In this case the complainant was upset about words spoken to him by TCC. In response, the complainant raised a tool in a manner in which an ordinary person would think was being brandished as a weapon, aggressively approached the accused and swung the weapon at his face. The accused responded with a single punch that grounded the complainant. The fight was over. TCC told the police that he defended himself. Though other witnesses did not see the actual physical exchange (because it was out of view), they corroborated that it was the complainant who quickly approached the accused with a tool in hand. Notwithstanding this evidence, police charged TCC with assault causing bodily harm. Not surprisingly, TCC pled "not guilty". On the day of trial TCC successfully defended the charge.
