R. v. M.H.M.M.
R. v. M.H.M.M.
(Calgary Court of Justice - Mischief). The lesson relating to MH's case is that even when the accused has a very strong case, the risk of conviction combined with the trial fees often drives resolution. David Chow is a Calgary criminal lawyer who offers a cost competitive, affordable initial retainer and while David's trial fees reflect his decades at the criminal bar, he does everything in his power to resolve cases prior to his client incurring expensive additional litigation costs. It is not uncommon for potential clients to think that a lawyer is self interested to the extent that the lawyer will set every case for trial. That is not David's practice.
MH had almost a sure winner. The allegation was that MH damaged a taxi cab. The Prosecution was relying upon a taxi video. The video, however, did not identify MH as the culprit. The case was ultimately resolve by way of Alternative Measures and the charges against MH were withdrawn after MH made a donation to a local community service.
While David Chow was the view that MH had as close to a sure winner as the criminal law will see, trial could not be recommended. There are always risks in going to trial.
David Chow runs a boutique criminal law practice where he offers more personal service to clients. David never takes on more cases in any given year than he can manage effectively, while making best efforts to always provide quality customer service. Although David is often busy and focusses on the client that he has directly in front of him -- who needs his immediate attention -- and as such cannot always be immediately responsive, he makes every effort to communicate routinely and effectively with his clients.
