R. v. L.C.
R. v. L.C.
(Lethbridge, P.C.J.) The accused successfully obtained bail in relation to an assault involving the discharge of a gun. The first priority to defending any charge is bail. Detained persons make different decisions; sometimes even rash decisions not necessarily connected to their best defence. In tis case, L.C. was charged with aggravated assault with a firearm, attempted murder and unlawfully discharging a firearm. The Defence illuminated issues in the Crown's case, which included frailties in eyewitness identification and a dearth of evidence proving that an actual firearm was discharged. A gun might appear to be a gun but not meet the definition of "firearm" in the Criminal Code of Canada. Prioritizing bail in this case was critical; for Lethbridge criminal lawyer, David Chow, ultimately successfully defended the case.
