R. v. K.S.S.
R. v. K.S.S.
(Canmore, P.C. - DUI/Over 80). KSS was charged impaired operation of a conveyance and operating a conveyance with blood alcohol at or over the legal limit. The investigation began with a complaint to the police from a source outside the police. The complainant led to the home of the accused who was almost immediately arrested with very little done by police to corroborate their source's information. KSS filed a Charter Notice alleging breaches under sections 7, 8 and 10 of the Canadian Charter of Rights and Freedoms. KSS's case illustrates the importance of not placing the cart-before-the-horse; viz., investigate before arrest, not after. Beyond the Charter issues, the Prosecution was also challenged by other evidentiary problems. KSS successfully defended the case on the day of trial.
