If you are in need of an Airdrie criminal lawyer to defend your case, don't limit your search to Airdrie alone -- for there are many criminal defence lawyers in Calgary who routinely make the trip to this jurisdiction. DC was charged with uttering threats in an incident involving a dangerous driver. In this case, a person operating a Government truck was, in the opinion of DC, driving dangerously while travelling at excessive speeds. DC ran across a supervisor's vehicle for the agency that likely employed the dangerous driver. DC spoke to the supervisor in a manner that the supervisor interpreted as being threatening. Police were called and DC was eventually charged.
DC did not agree to uttering threats; however, since DC did not have a prior criminal record, the Prosecutor agreed to resolve the case by way of Alternative Measures. It is not the alternative measures resolution that is the interesting lesson from DC's case.
What makes DC's case a good lesson for anybody charged with a criminal offence anywhere in Alberta is to always do your level best to protect yourself against a criminal record. Years before DC's uttering threats charges, DC was accused of impaired driving. David Chow was DC's criminal defence lawyer. The case was set for trial and prior to trial was supported by fully argued Charter Notice outlining the basis for excluding evidence in DC's case. DC successfully defending the case on the day of trial and did not incur a criminal record. Had DC had a criminal record, there is a strong possibility that the 2024 Alternative Measures resolution would not have happened.
When prosecutor's evaluate a case for resolution, they almost automatically determine whether the accused has a prior criminal record. A prior criminal record can dramatically change the landscape for resolution options and often results in plea bargains that expand on the criminal record rather than keeping charges to a minimum.
