R. v. C.E.P.
(Medicine Hat, P.C.). Client was charged with a serious home invasion involving a firearm. This was an extremely serious home invasion, which involved violence and the pointing of a gun. The home invader was injured when he smashed the victim through a glass table and as a result, left a trail of blood from the table, through the kitchen, with prints on the door, across a yard, to a garage and in a vehicle that was stolen. Defence argued "identification" and that the D.N.A. evidence could not be relied upon. The eyewitness identification evidence was challenged in cross-examination. The expert's opinion with respect to the DNA was argued to be weightless as a result of the failure by the Crown to prove critical foundation evidence. After a lengthy trial, and written argument, the judge was left with a reasonable doubt and the client was acquitted. This was a serious case that as a result of the biological materials, could have easily been evaluated by the defence as weak.
