R. v. D.J.S.
Posted in Impaired Driving, Bail andJanuary 9, 2012
[Calgary, ABCA] - The Appellant was charged with impaired driving causing bodily injury and dangerous driving causing bodily harm and convicted. DJS appealed his convictions and hired Calgary impaired driving lawyer and Appellate Counsel, David Chow, for the purpose of conducting a "bail pending appeal". Bail pending appeal is effectively judicial interim release while a case is at appeal. To obtain bail pending appeal the Appellant must establish that the appeal is not frivolous, that he will surrender himself back into custody if the appeal is unsuccessful and that it is not against the public interest to release the Appellant while awaiting his/her appeal. DJS successfully obtained bail pending appeal on reasonable terms. David Chow is a Calgary trial lawyer and Calgary Appellate counsel who has appeared at the Supreme Court of Canada.
