Break and Enter occurs whenever a person intentionally enters a premises for the purpose of committing an offence.  For example, break and enter to commit assault or break and enter to commit theft.  Break and Enter -- especially into a dwelling house -- is considered a serious offence because the act violates the home sanctuary. In short, people need to feel safe in the places they occupy.

Home invasion is one of the most serious violent crimes recognized in our criminal law. The distinction between a home invasion and an ordinary break and enter is that a home invasion has an element of violence.  In Canada, break and enter is considered to be a serious invasion of the privacy interests of citizens who are entitled to exist within the security of their own home sanctuary. If the offence involves violence, and is thus a home invasion, the Alberta Court of Appeal has established 8 years in a Federal Penitentiary as the starting point sentence.

With this in mind, it is critical that you successfully defend any break and enter or home invasion allegation. David Chow is a Calgary defence lawyer who has successfully defended the entire spectrum of break and enter cases. He has been trial counsel in serious home invasion cases involving firearms and violence.  He represents clients throughout Alberta, including Medicine Hat, Lethbridge, Calgary and Cochrane.
