SafeRoads v. K.G.
SafeRoads v. K.G.
(Alberta SafeRoads - Immediate Roadside Sanctions). KS was issued a Notice of Administrative Penalty based on a police officer's reasonable grounds that he committed an impaired driving offence. The ground for cancellation in KG's case was very straightforward: the Director of SafeRoads failed to provide documentation owed to calibration and maintenance of breath testing equipment. As this constituted a clear ground for cancellation, KG's roadside sanctions were set-aside. Notwithstanding the decision was favourable, KG still suffered the pains of the process, which included nearly a full month driving suspension, vehicle seizure and impound fees. Rather than releasing the vehicle from impound without payment, the lot required full fees with KG to pursue the police and Government for the return of money. In the opinion of this Calgary criminal lawyer and Alberta Roadside Sanctions lawyer, this case demonstrates the atrocious brinkmanship and abuses of our law.
