R. v. W.T.T.
R. v. W.T.T.
(Court of Justice, Calgary - Assault). As most criminal defence lawyers and prosecutors in Alberta are aware, cases of domestic violence can present challenges for the Court system. While it is not unusual for allegations to result in charges arising from within a domestic relationship, it is also not unusual for both sides of the domestic dispute to change their position with respect to the prosecution as the case proceeds through court. Issues to these types of criminal cases range from questionable allegations of domestic abuse to witnesses who become less cooperative over time to clear cases of domestic violence that require a response from the criminal justice system.
In WT's case, there were concerning allegations of domestic violence for which the complainant almost immediately resiled from. The accused's position was that the allegations were false. While there was evidence to support the prosecution's case, as a result of the witnesses level of cooperation, the prosecution had to make decisions with respect to the case that it might not have otherwise made.
With urging from WT's Calgary criminal lawyer, the case against WT was ultimately resolved by way of a peace bond.
