R. v. V.T.V.
R. v. V.T.V.
(Swift Current, P.C. - Impaired Driving/Over 80). VTV was charged with impaired driving and operating a motor vehicle with blood alcohol at/over the legal limit. Notwithstanding that David Chow is a Calgary based impaired driving lawyer, he routinely handles cases arising out of Swift Current, Saskatchewan.
Unlike the Province of Alberta -- who generally handles impaired operation cases using the Provincial Administrative Penalties Legislation (Roadside Sanctions) -- Saskatchewan still prosecutes DUI charges criminally.
VTV filed a Charter Notice alleging many Constitutional violations. One such violation included that despite VTV demonstrating no meaningful indicia of impairment and was cooperative, the investigating RCMP officer lodged the subject in cells (the drunk tank) for nearly 7 hours. This was done without cause.
As a result of the various Charter breach allegations, VTV successfully defended the criminal charges and avoided the potential permanency of a criminal record.
David Chow's office is located in Calgary, Alberta. He is a full service Alberta criminal lawyer who handles cases throughout Alberta, Saskatchewan and British Columbia. If you are searching for a lawyer outside of the jurisdiction of Calgary (this area includes Cochrane, Canmore, Okotoks and Airdrie), it is recommended that you make best efforts to find local counsel. This will undoubtedly be more cost effective. However, if you cannot find a lawyer in your jurisdiction, David Chow is a Calgary criminal lawyer who is happy to make effort to earn your business.
