R. v. K.W.
(Calgary, Q.B.). Calgary drug lawyer secures acquittal in a drug trafficking case! Client charged with possession for the purpose of trafficking two kilograms of cocaine located in the trunk of a motor vehicle. KW was charged after she was arrested during an alleged exchange of drugs in an underground parkade in Calgary. Drugs were located inside of a secret compartment of a motor vehicle operated by her, thus triggering defences under the Canadian Charter of Rights and Freedoms and the common law (possession). The defence raised issues relating to the propriety of the arrest and search. The argument was that the arrest was premature, based on little information relating to the accused. KW had never been on the police radar and as a result fo the alleged transaction occurring in a parkade, where police communications were interrupted and their observations limited, the question was whether law enforcement had objective grounds to arrest KW and search the motor vehicle incident to arrest. The arrest was also made at gunpoint. The Court of Queen's Bench Justice agreed with Calgary drug lawyer, David Chow and excluded the evidence. The client was acquitted. This prosecution is yet another example of one which was defended after a long and careful review of the file from an experienced Calgary drug lawyer.
