R. v. I.S.
(Cochrane Court of Justice - Assault). IS was charged with a domestic assault arising from an allegation involving a domestic partner. On review of the case, the defence was of the view that the Prosecutor had no reasonable prospect of conviction. In short, the disclosure did not reflect the commission of a criminal offence. While "reasonable prospect of conviction" is not an onerous test, it nevertheless requires the Crown to have at least some evidence, upon which a reasonable jury, properly instructed, could convict. This was absent in IS's case.
