R. v. C.G.

(Court of Justice, Calgary - Firearms).  An important lesson for every firearms owner is to ensure that guns are stored safely and properly at all times. Unfortunately, sometimes even the most responsible firearms owner can become temporarily distracted.  In CG's case a firearms was being cleaned on a kitchen table. While cleaning the firearms CG had to attend for an emergency and left the firearms on the table. Unfortunately for CG property management of the condominium had a planned and pre-arranged inspection of some water lines. When property management entered the home, the firearm was observed on the table and the police were called. CG had all firearms seized and was charged with firearms offences under the Criminal Code of Canada

CG's case progressed through court of a few months. Fortunately, CG's Calgary criminal lawyer managed to have a productive discussion with a very reasonable prosecutor. Ultimately, the Crown agreed to withdraw the charges on condition that some of CG's firearms would be surrendered, with others being released to a third-party in possessing of a valid firearms license.

When it comes to firearms handling and storage due diligence is the standard at all times. Section 86(1) of the Criminal Code makes it an offence to use, cary, ship, handle or transport a firearms in a careless manner and it is an offence under s. 86(2) to improperly store a firearms in contravention of regulations made under the Firearms Act

While there are many Calgary criminal lawyers, not every criminal defence lawyer has experience defending firearms offences. There are specific provisions in the Criminal Code speaking to firearms crimes and many of these offences are connected to the Firearms Act and the Firearms Act Regulation.  David Chow runs a small criminal law practice, taking on only the number of cases that he can responsibly handle at any given time. David offers a free, one-time, initial telephone consultation for criminal law and roadside sanctions cases only. If you have been charged with a criminal offence (such as a firearms charge) or have been issued a roadside sanction for impaired driving, consider contacting David Chow. Since David is often in Court or in hearings -- if there is no answer -- please leave a short voicemail message. Also, if you are calling for another person, it is highly recommended that you have the person who is in need of a criminal defence lawyer reach out to that lawyer. This is so because the defence lawyer will need to speak to the person who is in need of assistance. Moreover, solicitor-client privilege only applies as between the lawyer and the client who is in need of the legal service.
