R. v. C.E. et al

Client was charged with break and enter with intent to commit robbery.  After 5 days of trial, the client was acquitted on grounds that the crown failed to prove the mens rea and actus reus of the offence.  Notwithstanding that the Crown sought convictions for lesser included offences, such as theft and possession of stolen property, the client was acquitted on grounds that the trial judge was left with a reasonable doubt.
