R. v. C.C.C.
(Cochrane Court of Justice - Assault Causing Bodily Harm). CCC was charged with assault causing bodily harm in relation to an incident where the Crown Prosecutor alleged that the accused pushed a domestic partner down the stairs. It was alleged that the complainant sustained a broken pelvis. The accused's position was that while there was a fall down a couple of stairs, there was no assault. The accused's position was that the complainant cause its own fall and therefore was the author of its own injuries. The accused pled not guilty and the case was set for trial.

Credibility is often central to the assault case. After reviewing the case, the Crown offered a resolution that the accused would not have been wise to refuse. It is not unusual for accused persons to receive the best resolution offer on the day of trial. This is so because the reality of trial sets in. Witnesses are at risk of cross examination. The Prosecutor is often forced to triage cases in a trial court and therefore must prioritize cases on a busy docket. The accused resolved the case by way of a peace bond, with usual conditions and the charge was withdrawn. This was an incredibly positive outcome for the accused. The accused did not risk a criminal record and potential jail sentence.
